Expansion Team

Is there anyway to start as a brand new expansion team in the Major Leagues? Or do a fantasy draft?

Yes and yes.

While setting up a fictional league, there is an option to hold an inaugural draft, which is the fantasy draft you're looking for. In an MLB league, I don't think you get the option during setup (but you might). If not, you can go to the league setup options and choose the button that says "release all players and schedule draft" or something to that effect.

I don't remember off-hand the exact process (or timing) for expanding MLB, but others can answer that.

You have to sim one season before you can expand and run a draft.

This is no longer true. In OOTP 13 and 14 it now starts before opening day so you can do the following

In the setup screen under league options you can do any of

Release all FA and run a fantasy draft

or

Expand League and run expansion draft

or

Expand League, choose not to run an expansion draft and then release all Free Agents and have a fantasy draft

All 3 can be done in both a fictional league and MLB quickstart

Note: You must turn on ghost players to expand in an MLB quick start because there isnt enough players and you wont have time to sign free agents

Or generate more free agents. Or delete some of the minor league teams for your expansion team and bring them back next year.

To start as the Rockies, Marlins, DBacks or Rays and draft your own players you would have to start with 1992 or 1997, otherwise you start with the players who they had on their OD roster. This is what Charlie meant, to my knowledge.
