Seriously though, I wondered about this too, but I "hid in the shadows" and didn't speak up. Makes sense though, and I hope we continue to go fairly "unnoticed"...

Thanks for the great info Jim.

For the most part things are the way I thought they were. Except
I thought an athletes name (especially in the context of his sport) wouldn't be public domain. But they need to have it trademarked. Makes sense when you think about it. I guess Player Unions hold the trademarks to player/member names in sports like baseball or at least negotiate on the players behalf.

As far as images go... and photographs specifically... wouldn't you need the photographers permission to use a photo? Assuming the photographer had permission to use the photo from the fighter.

Anyway...thanks for the info Jim, it cleared up that merky legal area significantly.

Thats what my understading of it was, especially in the context of a game that portrays a boxer ratings/age/era wise the same as a real life boxer with the same name.

Now that I have a clearer view of it, it doesn't seem to be as abig of a problem as I thought.

Just to stir up the pot.....
As long as you sell the game exclusively over the internet your fine. If a boxer trademarks his name and asks you to remove it or pay. You can just remove it and all future purchasers will have the version without his name.

But....what if the game was distributed and sold at retail outlets. I wonder if the boxer could force you to recall those copies illegally using his name. That could get messy. Or maybe they are already considered sold when the retail outlet purchases them? Hmmm... I don't know....
