Kobe vs. Premiership footballers

http://news.bbc.co.uk/1/hi/uk/3154184.stm

I don't know what to say or feel about this. Just disturbed about how Kobe and the footballers were treated so differently.

One difference is that there have been no charges brought yet. The media naming people before the case is brought now leads to the case being unprosecutable under English Law, and numerous high-profile cases have collapsed under this (an attack on an asian student by two leeds united footballers was declared a mistrial after the papers called it a 'racist attack', which would prejudice the juries).

Moreover, the media recently named Scottish television personality John Leslie as a chap involved in a rape allegation. 24 women came forward, eventualy 1 set of charge of 'improper conduct' were brought but it was thrown out of court. While Leslie's qualities as a human being are still in question, nevertheless his life was ruined by allegations before charges had been brought.

The papers don't care about securing a conviction, just selling more copies. Trust me, when charges are brought, things will get very nasty...

Here's the legal reasons for not naming:

Kobe was named before the charges were made. I do not want to sound like a supporter of anyone in both these cases, but I do believe the British case was handled better.

I agree entirely.

The unfortuanate footnote is that the team has been identified - it was printed in a rag called the Daily Sport yesterday, and its relatively easy to work out (unless we're jumping the gun). The players' names are available on the internet, but I'm trying to remain dignified and not check them out.
