I don't know.......some jurors might see Kobe's charisma and charm as just more damning evidence against him i would think. What do you think?

I think that this columnist has a point, but it doesn't necessarily make a conviction impossible. The main problem for Kobe is to what extent did he deliberately deceive the authorities about what happened that night? There are reports that his story changed and if it changed a whole lot, it will cloud the rest of his testimony, if he takes the stand (which i think he will).

To me, the prosecution has a couple of problems. First of all, they had Michael Baden, the forensic pathologist from the HBO show Autopsy (excellent show), on one of the news networks the other day and he was saying it's virtually impossible to determine consent from vaginal/anal injuries suffered during intercourse. So unless she has other injuries that are overwhelming, it's going to be hard for the prosecution to show the extent to which she resisted.

According to the LA Times timeline, Kobe had sex with the alleged victim, then had surgery, then hung around the hotel all day, going in and out of the lobby, then went to the hotel restaurant and had dinner, played chess with his bodyguards and spoke to other people in the restaurant for about 3 hours. He didn't check out of the hotel until after he was questioned by the police and taken to the hospital for tests. Even the day after the alleged rape, he wasn't acting like he did anything wrong, which is hard for someone without any priors to do.

When Kobe left the courthouse yesterday, he got an ovation like he just dunked on Tim Duncan. His celebrity seems like it will be omnipresent. If this is the case, I would imagine that's a huge problem for the prosecution.

A few things .... first very intelligent post. The first paragraph above IMO proves nothing. Maybe he didn't think he did anything wrong. Maybe he thought I'm Kobe Bryant, I can do what I want. Or maybe he was thinking she liked it that way. Who knows, Kobe is extremely private. Even some of his teammates have said they'd like to think he wouldn't do that but we don't know him. Also it's kinda damned if you do, damned if you don't. Kobe is smart enough to know if he took off right away he'd look guilty. Tyson bolted town within an hour of attacking Desire and that went a long way to convicting him. If the defense argues he is innocent because he didn't take off right away a smart prosecuter (like a Harvard grad) will eat that for lunch. If the defendant was an idiot that's on thing, but if I remember correctly, Kob's IQ is quite high.

I'm willing to bet that the idiots cheering an "alleged" rapist in front of the courthouse were not from Colorado. The average income in Eagle County is well into the millions, I doubt they are in awe. I lived in Colorado for several years and all those small mountain towns on the Western Slope are very tight knit. If anything, Eagle County is a problem for the defense not the prosecution.

edit ... One last thing, rape cases are hard to prove. I have to think the prosecuter has some sort of smoking gun, since he took so long to file the charges.

I agree that Kobe will be really tough to convict. I think there's an excellent chance he really did commit the crime, but unless the prosecutor has some really phenomenal evidence (e.g.: earwitnesses from nearby rooms, a confession to the bodyguards, possibly torn clothing combined with facial bruises) I think he'll likely be acquitted.

I know. I don't know what is wrong with the guys here. If you go to the lunch thread you will see that I go run three miles everyday, almost, for lunch. That means I am out in the heat at noon every day. I don't have a problem with the heat. I have no clue what is wrong with the football players, who are suppose to be in shape. What is bad, is the last guy to go down with the heat was a Wide Receiver.
