I played around with it a little bit, and it seems that players with 5 or more years of pro experience can refuse assignment off the 40-man, just as players with 5+ years of MLB experience can refuse assignment to the minors (which is what the little S icon stands for).
Also, the game definitely gives you the "accepts/refuses" decision before you put the player on waivers, as long as you drag the player from the 40-man to the white box. If you drag him from the 40-man to the waivers list (or from a minor league roster to the waivers list), the game doesn't know why you're putting the guy through waivers, so it doesn't ask him whether he'll accept reassignment. (It also might make them clear waivers again if you don't go from the 40-man to the white box; I remember reading somewhere that you had to be careful with how you got your guys to clear waivers.)
