Does your team currently possess his NHL rights? If he was on an expiring contract and you failed to qualify him, you lose the rights to him and he becomes a free agent.
If that's what happened, but you want to bring him onto your team anyway, use Commissioner Mode to edit his NHL rights to your team, and then offer him a contract. Alternatively, you could just edit his contract manually.
