Had penalties been assessed against the players, it would have been the Union's responsibility, both legally and ethically, to defend the players punished and, from a reasonable amount of reading about the grievance process, the league would have had a very tough time winning those grievances.
I don't think it will hurt the union and it is quite possible to defend individual players if needed and still be in favor of rule changes protecting the rest of your rank and file.
