If a player does not have an NHL contract, they can be selected.
It's not likely to be changed until the NHL does. While I (as a hockey fan) hope the NHL do go back, it's far from a guarantee. The NHL doesn't like stopping the schedule or players getting hurt. The PA wants it, but are they willing to give up whatever they need to get it? No guarantees in anything.
