If you want OOTP to come with the NCAA name and official school logos when you buy it, Markus is going to need to a acquire a license for the same reason that he had to take MLB team names out and subsequently acquire a license from MLB.
The best way for folks to have the NCAA added to their game is through a community mod, which you just said you're already taking advantage of.
