Maybe its just me, but i don't think the trading team should be able to make a waiver claim on the person they are trying to trade for.

That's actually how things work in real life- the team will claim the player on waivers so that no other team with lower waiver priority can prevent the trade by claiming the player. Of course, the teams will then go on to complete the deal, which, as you point out, doesn't happen in OOTP. So I think that's how things should work in OOTP- when a waiver deal is made, the only claims that should prevent the deal from happening should be those made by teams with higher waiver priority than the trading teams.
