Players become eligible for the rule 5 if they are not protected on the 40-man, and they've been around long enough (three or four years, depending on how old they were when they began their minor league career). OOTP used to implement this incorrectly; in OOTP 2006 and pre-patch 2007 (if I remember correctly), veteran players (with more than six pro years) were excluded from the rule 5. I think this was only fixed in the latest patch, and now works as in real life. Just this past year, Jason Smith and Josh Phelps were taken in the rule 5, and both had more than 6 years of pro experience. Chris Gomez was in a similar position when he was rule 5'ed by the Phillies a couple of years ago.
