And your responce is my point. It is the games decision to do it that way, and their decision isn't based on whether or not it is legal. Because as of right now, it is.
In my opinion, it is a poor decision. Some players play fictional, some historical, but many of their customer base enjoy current rosters.
I also believe that the decision is made easier for them, because they know someone else will do it anyway.
In all honesty though, I suspect (yes, baselessly) it was a financial, man hours decision .. and not a legal one.
* Note. I don't think it was a make - or - break "poor decision", just one that could've enhanced their game to some of their customers.
