While there's no setting that spells it out, refusing removal from the 40-man roster is a feature in the game. I tried to find an example that would be repeatable, but the best I could do is this:

Take a fresh copy of Career 2004.lg (or a new Standard League), take human control of Chicago(N), and waive C H. Coronas (drag from 40-man to waivers). Three days later, he should clear, and when you demote him (drag from active roster to AAA), you get a message "The player accepts the assignment". Then remove him from the 40-man (drag from 40-man to white box) and you get another "The player accepts the assignment". Accepting implies that he could have refused; thus there are two separate accept/refuse scenarios: minor league assignment and removal from the 40-man roster.

Plus I've had players refuse assignment off the 40-man, as did the original post, so I know it's in there.
