The 40 man roster rule is simple, if the player has a big league contract, the game will not let you move him off the 40 man roster. It doesn't come down to the player refusing. The only way to get a player with a big league contract off the 40 man roster is to get him off your team via trade or cut.

While there's no setting that spells it out, refusing removal from the 40-man roster
is a feature in the game. I tried to find an example that would be repeatable, but the best I could do is this:
Take a fresh copy of Career 2004.lg (or a new Standard League), take human control of Chicago(N), and waive C H. Coronas (drag from 40-man to waivers). Three days later, he should clear, and when you demote him (drag from active roster to AAA), you get a message "The player accepts the assignment". Then remove him from the 40-man (drag from 40-man to white box) and you get another "The player accepts the assignment". Accepting implies that he could have refused; thus there are two separate accept/refuse scenarios: minor league assignment and removal from the 40-man roster.
Plus I've had players refuse assignment off the 40-man, as did the original post, so I know it's in there.
